The Election Commission of Pakistan (ECP) has suspended the upcoming by-election for a vacant Senate seat previously held by Murad Saeed, following a legal challenge to his de-notification. The commission issued a stay order on Tuesday, putting the April 23 polling on hold and adjourning further proceedings until May 7.

A three-member bench heard the petition filed by MPA Jalal Khan, who questioned the legality of removing Saeed from office. During the hearing, the petitioner’s counsel argued that Saeed, although elected as a senator, never took the oath of office. According to the argument, a candidate formally becomes a member of the Senate only after taking the oath, raising doubts about the validity of his de-notification.

The lawyer requested the commission to delay the by-election until the legal ambiguity surrounding the matter is resolved. After reviewing the arguments, the ECP accepted the request and directed all relevant parties to respond, issuing notices accordingly.

Senate to Review 54-Point Agenda in Session Today

Murad Saeed was disqualified from his Senate seat on March 26 after being convicted in a case related to the May 9 incidents. An anti-terrorism court had sentenced him to 10 years in prison, prompting the ECP to declare his seat vacant under constitutional provisions.

The case has drawn attention due to its implications for electoral procedures and constitutional interpretation. Legal experts suggest the outcome could set an important precedent regarding when an elected individual is officially recognized as a member of parliament.

Until a final decision is reached, the Senate seat will remain vacant, and the election process will remain suspended. The next hearing is expected to provide further clarity on the legal and constitutional questions raised in the petition.
